INTRODUCTION

 

 

WHY THIS GUIDE

 

This “Foreign citizen’s guide to services” arises from the experience of encounter, co-ordination, information and instrument exchange among different institutions and associations present in the territory, that often work in contact with foreigners, on different levels and within their own field of competence.

The presence of foreigners in the territory of Frosinone and their interaction with the institutions create a series of exigencies and requirements from both sides: on one hand to resolve rapidly and efficiently the many daily problems of foreigners in Italy, and on the other hand to update, co-ordinate and collaborate so as to guarantee required services and “good functioning” of the administration.

The meeting between institutions and associations has been promoted under the initiative of Department 3D -Non EC and Ethnic minorities operating unit - of ASL of Frosinone, in implementation of circular letter n.49 of 8 September 1997 of Regione Lazio, in which is provided health assistance also for those foreigners without regular residence permits, promotion of collaboration of the institutions with associations and the formation of institution co-ordination. From this arises the Agreement protocol drawn up between ASL Frosinone, Department 3D, Caritas of Alatri, Anolf-Cisl, Islamic Association Ettuba and Oltre L’Occidente, as associations locally committed to the protection of immigrants’ rights.

To the co-ordination of associations-institutions participate also: Infantile maternal Department and Mental Health Department of ASL Frosinone, Local Education Office, Police headquarters (Foreign Office), Prefecture, Social Service Office of the Comune of Frosinone, Provincial Administration, Adult Social Service of the Ministry of Justice, Provincial Direction of Employment, Caritas of Alatri and Anagni, Anolf-Cisl, Ettuba Association, Association Oltre L’Occidente. All these boards are co-ordinated by the social assistant responsible for the Non EC and Ethnic minorities operating unit of Department 3D of ASL Frosinone.

From meetings among these boards has risen the exigency of information and training of operators in order to supply efficient services. In view of this aim, an informative guide has been designed, supported by an information and service office (the Multiethnic centre) which has been activated within the Asl of Frosinone, Via Armando Fabi, at which foreigners may enquire especially for information on health and protection of their rights in general.

A BRIEF MENTION OF LOCAL REALITY

 

According to Dossier ‘99 of Caritas of Roma, in the territory of Frosinone and its province, there are about 5150 foreigners, 1,05% of the local population, for the most part Albanians and Moroccans

Such a limited presence in the territory delineates the possibility of integration of the communities, far away from the clamours and the emergencies to which media have accustomed us. This allows us then to activate all those instruments provided by law 40/98: from Italian courses for foreigners to those of their mother land, to multi cultural exchange, to the protection of young foreign children and to the promotion of all those initiatives that may realise the potentialities arising from the encounter of different cultures.

Not only does the co-ordination of institutions and associations propose these instruments, but also the realisation of means of participation to the democratic life of foreigners: the added consigliere comunale, provided by regional laws and already present in other Comuni of Italy, the possibility of meetings among people from other countries through the figure of the cultural mediator, the activation of instruments provided by law 40/1998, such as courses of Italian for children and adults, foreign language courses to be organized in schools so that foreign children who attend school may not lose the ties with their origins, and all other initiatives that may be useful in transforming the “immigrant emergency” in a advantageous reality, rich in possibilities.

 


 

  I.   ENTRANCE TO ITALY

 

HOW TO ENTER ITALY

 

 

DOCUMENTS

When entering Italy, a foreigner must have:

· valid and not expired passport, issued from country of origin, or identity certificate, issued from Embassy or Consulate of Country of origin in Italy;

· entry visa for Countries that require it;

         Entry visa is issued by the Italian Embassy or Consulate in Country of origin or provenience. Those issued by other Embassies are the same, but only for no longer than 3 months residence.

         Upon issue of entry or transit visa, a written communication in a language intelligible to foreigner is presented to the foreigner, communication that explains his/her rights and duties relative to entry and residence in Italy.

         The refusal of entry or re-entry visa is adopted with written and motivated measures.

         Entry in Italy is allowed either with short term residence visa (up to 90 days) or with long term residence visa, which requires concession of residence permit with identical motivation to that indicated on visa. Two types of visa are distinguished, visas for people who want to reside in Italy and transit visas, with short term validity, to pass through Italy and continue journey to other countries.

 

· documentation relative to purpose of residence;

· documentation relative to means of subsistence (money and accommodation) for duration of residence and -with the exception of visa for employment reasons -for return in Country of origin.

 

N.B. All documents from foreign Nations and used in Italy must be translated into Italian by an interpreter registered on the list of the Court. Translation must be sworn in Court, in the presence of a registrar or other public officer.

 

 

FRONTIER CHECK

 

         Legal entry to Italy is allowed only through frontier crossing points purposely established.

 

         Foreigners already expelled from Italy cannot enter Italy, and therefore are rejected at the frontier (unless period of prohibition has already expired and special authorisation has been obtained), and foreigners signalled for security and public order reasons, also according to international conventions.

 

 

 

MIGRANT FLOW FORECAST

 

         Every year the Prime Minister, with a decree, establishes the maximum quota of foreigners allowed in the territory of the State for employment – also seasonal - and for self employment. All employment visas are issued within the limit of aforesaid quotas.

 

 

 

RESIDENCE PERMIT

 

WHAT IT IS

 

         A Residence permit is the document that states the possibility for a foreigner to reside in Italy; reasons and length of residence are always indicated on the document.

 

Document may be issued for:

 

· tourism;

· subordinate or self employment, for definite or indefinite time;

· health (recovery in private or public hospitals);

· minister of worship;

· study;

· family reuniting.

 

 

 

HOW LONG IT LASTS

 

Duration of residence permit is generally that of entry visa and is of, particular cases apart:

 

· 3 months – for tourism, business, visits;

· 6 months – for seasonal employment;

· 1 year – study reasons;

· 2 years – for subordinate or self employment, family reuniting.

 

 

HOW TO OBTAIN IT

When it is requested

         Issue of residence permit must be requested within 8 days of entry in Italy at the Questura (Police Headquarters) of the province in which foreigner is at present (see Chap. VII).

 

         On request Police Headquarters issues a receipt of request, a receipt that states that the foreigner is awaiting residence permit.

         If a foreigner does not declare his presence in Italy and does not request residence permit within 8 days of entry, the same is issued with a fine of £.200.000 and £.500.000; if a foreigner does not declare his/her presence in Italy within 60 days of entry, the same may be expelled (see Chap. VII).

 

 

Necessary documents

In order to obtain residence permit, a foreigner must present to the Questura (Police Headquarters) a written application for the issue of a residence permit on stamped paper of £.20.000, enclosing:

 

· four photographs;

· photocopy of passport or equivalent document;

· documents that certify reasons of residence (for ex. employment contract, etc.).

 

It is the concern of the Police Headquarters to inform applicant if new requisites are required to obtain residence permit.

 

 

Useful information

 

· Residence permit must be issued, renewed or converted by Police Headquarters within 20 days from application.

· If permit is refused, revoked or not confirmed due to lack of requisites, the foreigner may be expelled. Against these measures (revocation of residence permit, lack of renewal or issue) it is possible to appeal to the Tribunale Amministrativo Regionale (TAR) - Regional Administrative Court.

· Residence permit for employment may be utilised also for self-employment.

 

 

RENEWAL

 

Renewal of residence permit must be applied for at the Police Headquarters of the province in which one lives at least 30 days prior to expiration and may be renewed for a term not longer than twice of initial term.

 

SPECIAL RESIDENCE PERMITS

Residence permit for family reasons

Such a permit is issued:

 

· to a foreigner who enters Italy for reuniting the family (see Family reuniting);

· for residing foreigners who married in Italy an Italian or other citizen of the European Union;

· to a foreign parent, also natural, of an Italian child.

 

Minors’ Court may authorise entry or permanence of a foreigner in Italy, departing also from law dispositions, if it deems that the presence of the relatives may resolve a difficult situation of serious prejudice for the psyco-physical development of minor.

 

 

Residence permit for social protection reasons

The Questore (Police Superintendent), on request of the Procurator of the Republic, may issue a Residence permit to the foreigner who is in a violent or very dangerous situation or in case of exploitation, so as to allow the interested person to avoid violence and to participate in a program of assistance and social integration, the development modes of which are communicated to the Mayor of the city concerned. This permit may also be issued at the moment of release from prison of the foreigner who has served a detention sentence inflicted for offences committed as a minor age and who has given proof of participation in a program of assistance and social integration.

Such a permit lasts 6 months and may be renewed for a year, or for a longer term necessary for above mentioned justice reasons and allows the registration with the National Health Services and placement lists.

The aforesaid permit may be converted into Residence permit for study reasons if ever the necessary conditions arise.

 


 

GUARANTEE SERVICE

 

WHAT IT IS

 

         The guarantee service allows Italian or foreign citizens regularly present in Italy to request nominally a foreigner who resides out of Italy, so as to allow him/her entry into our Country. Guarantee service can be allowed to a maximum of 2 foreigners every year. The residence permit issued on guarantee service lasts one year.

 

 

WHO CAN SUPPLY IT

 

A guarantee service can be supplied by:

 

· the Italian or foreign citizen who requests, within 60 days of publication of decrees on entry fluxes, a nominal request to the Police Headquarters of the province of residence. The Police Headquarters issues the apposite authorisation. Applicant must give proof of being able to ensure the foreigner with accommodation, subsistency and health assistance. Authorisation from Police Headquarters must be used by foreigner within 6 months;

· regions, local boards, professional associations, trade unions, voluntary associations that have been working  in the immigration sector for at least 3 years, who are able to supply the above mentioned factors.

 

 

 

 

 

 

 

 

 


 

RESIDENCE CARD

 

 

WHAT IT IS

 

Residence card is of unlimited duration. A foreigner with a residence card may:

 

· enter the State territory without a visa;

· enter into any kind of legal activity;

· participate in public life and have access to services supplied by public administration, unless differently arranged.

 

 

 

RIGHTS

 

Residence card may be obtained by foreigner who:

 

· has lived regularly in Italy for at least five years;

· has a residence permit which requires an indeterminate number of renewals;

· proves the possession of sufficient income so as to be able to keep him/her self and family;

· is spouse or minor child or parent of Italian or European Union citizen.

 

Residence card cannot be issued – and if issued will be revoked - in case of conviction for serious offences. Appeal to TAR is admitted if issue of resident card is refused or revoked.

 

 

 


 

EXPULSION

 

 

REASONS

Foreigner may be expelled from Italy if:

· he/she has violated Italian laws on entry and residence matters or has given false declarations on personal identity;

· he/she has been convicted with a sentence for serious offences (attempt and armed insurrection against the State, devastation and sacking, fire, labour exploitation, prostitution exploitation, theft, kidnapping, rape, illegal fabrication and detention of weapons, drug trafficking, Mafia association);

· has endangered State and public order security.

 

HOW IT OCCURS

There are two types of expulsion:

1. The first type is decided by the Prefetto and is carried out with motivated decree by the Police Headquarters of the province of residence. In this case the foreign citizen must leave the Country within 15 days or must present him/her self to the Police Headquarters so as to be accompanied to the frontier, always within 15 days.

2. The second occurs for public order or State security reasons or if the foreigner, already expelled, has not left the Country or has re-entered illegally. This expulsion is directly decreed by the Minister of Interior, who notifies the Prime Minister and the Ministry of Foreign Affairs and has immediate effectiveness.

The expelled foreigner is sent to his/her country of origin, or in the case that it is not possible, to the Country of provenience. In the expectation that expulsion is executed, the foreigner will be accommodated in “centri di raccolta” that will be instituted in different Italian localities and from which he/she may not depart. A foreigner expelled cannot re-enter the State territory without special authorisation from the Minister of the Interior; in the case of transgression, the foreigner will be punished with arrest from 2 to 6 months and will be expelled again with immediate accompaniment.

 

 

APPEALS

 

· If a foreigner is expelled with a decree of the Prefetto for illegal entry and residence in the State, the same may appeal to Court of place of residence within 5 days of notification of measure. Term is of 30 days when expulsion is executed with immediate accompaniment to frontier.

· If a foreigner is expelled for public order and State security reasons, by decree of the Minister of the Interior, the same may present an appeal to TAR within 60 days.

 

To present an appeal, a foreigner in economic difficulty may avail him/her self of a defence attorney at State expense, only if conditions provided by law are present (see Chap. VII).

 

This appeal may also be signed personally by part or, in the case of expulsion with immediate accompaniment to frontier, also through the Embassy or Consulate of foreigner’s Country.

 

 

WHO CANNOT BE EXPELLED

 

People who cannot be expelled:

 

· A foreigner who in the State of destination may be an object of persecution for race, sex, language, religion, political belief, citizenship reasons or who may risk being sent to another State in which he/she may not be protected from persecution;

· a foreigner who lives with Italian relatives within the fourth degree or with an Italian spouse;

· a pregnant foreigner or a foreigner six months following the birth of a child;

· a minor age foreigner, with the exemption of right to follow expelled parent or trustee.

 

 

 


 

FAMILY  REUNITING

 

 

RIGHTS

 

Foreigner with regular residence permit may ask for family reuniting with following family members:

 

· not legally divorced spouse;

· minor age children, either of spouse or born out of wedlock (only if other parent gives consent); adopted or entrusted children;

· dependent parents;

· 3rd degree invalid relatives according to Italian laws.

 

To obtain family reuniting foreigner present in Italy must prove:

 

· availability of accommodation;

· availability of yearly income, derived from legal sources, not less than amount established by law. This amount rises in proportion to number of people that are to be called into Italy.

 

Entry is allowed for reuniting the natural parent of a minor child residing in Italy, and who proves, within 1 year, the availability of income and accommodation above mentioned.

 

HOW TO OBTAIN IT

 

Necessary Documents

 

A permit request for family reuniting must be presented to the Police Headquarters of the place in which the foreigner lives while family members with whom applicant wants reuniting are still abroad. With this request must be enclosed:

 

· photocopy of residence permit;

· residence certificate and photocopy;

· declaration of employer that certifies that employment is of continuative type, indicating monthly average wage and last three pay scripts, all original and in photocopies;

· two photocopies of employer’s identity document;

· employment permit issued by Provincial Employment Office (Ufficio Provinciale del Lavoro) in original and two photocopies;

· photocopy of form 101 or, if self employed, certificate of registration with tradesmen’s list and photocopy of form 740;

· rent contract regularly registered or property title of accommodation of residence;

· two photocopies of passport of family member/s of which reuniting is requested;

· if request concerns spouse, wedding certificate must be presented.

 

 

USEFUL INFORMATION

· Procedure for issue of family reuniting lasts nearly three months. If Police Headquarters issues permit to reuniting, the foreigner may obtain entry visa for family members at the Italian Embassy or Consulate. Said visa must be utilised within six months of issue.

 

· If Police Headquarters does not issue permit to reunite family, the foreigner may appeal to the Judge of place of residence. The Judge, on hearing the person concerned, takes action with a decree. The decree of the Judge who accepts the appeal may decide to issue of a visa also in absence of permit.

 

· All deeds of this proceeding are stamp duty and register exempt.

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 


 

ASYLUM RIGTH

 

RIGHTS

 

The Italian Constitution guarantees foreigners asylum rights in case they do not enjoy democratic freedom in their own country (freedom of thought, religion, opinion, movement, expression).

 

Impediment to recognition of asylum rights are:

 

· refugee status already granted in another country;

· provenience from a country that adheres to the Ginevre Convention in which a foreigner has spent a period of residence of more than a year;

· commitment of crime against peace or humanity, war crime or serious crime in Country of reception.

Essential condition so as foreigner may really enjoy asylum right is entry into the territory of the Italian Republic. Frontier police cannot prevent refugees entry in Italy, even if they do not possess necessary documents.

 

 

  HOW IT IS OBTAINED

Necessary Documents

 

Request for recognition of refugee condition must be made within 8 days of entry in Italy or directly to the frontier police, which will send it to the nearest Police Headquarters or to the Police Headquarters of province where foreigner will reside.

 

Enclosed with request:

· declaration which explains reasons for request of asylum right;

· filled in prestamped form;

· 3 photos.

 

Procedure for acknowledgement of asylum right

 

· Police Headquarters competent on the territory must send within 7 days of  presentation, a request to the Central Commission for the recognition of the Status of Refugee. The Commission will then summon to Rome, for personal hearing, the foreigner who made the request. In the meantime Police Headquarters will issue a residence permit with the statement “waiting for political asylum”, valid for two months, automatically renewable till notification of the Commission’s decision.

· Foreigner’s national passport is confiscated by Police Headquarters, which provides in taking photos of foreigner, of taking finger prints and in issuing a photocopy of passport with words “political asylum”.

· For indigent applicant a first assistance contribute is provided of £.34.000 a day for 45 days; request of such contribute must be made together with political asylum request.

· Within 15 days of hearing, the Commission makes a declaration on the request; the motivated measure is sent to competent Police Headquarters, which notifies the person concerned.

· If the asylum request is accepted by the Commission, the foreigner is recognised as a political refugee and given an appropriate document. The latter is necessary to obtain administrative documents (residence permit and registry certificates) and to enjoy certain rights (family reuniting, citizenship).


 

 

 

 

Useful Information

 

 

· Refusal of asylum right may be contested, by legitimacy or merit, within 30 days of notification by applying to TAR. The assistance of a solicitor for this appeal is necessary.

· An applicant, whose request of recognition or appeal to TAR is refused, must leave the Italian territory, unless he/she possesses an other residence title; in fact the refusal measure is normally given together with an invitation to leave the territory or an expulsion decree. So the foreigner who wants to appeal the refusal of asylum right must contest the expulsion decree at the same time.

· During procedures of recognition of asylum right, foreigner cannot be punished for irregular entry in Italian territory and cannot be expelled unless exceptional reasons of national security or public order should arise.

 


 

   II   PERMANENCE IN ITALY

 

ITALIAN CITIZENSHIP

 

HOW TO OBTAIN IT

Italian citizenship is acquired by right:

· by birth: child of mother or father who are Italian citizens; children -born in Italy- of unknown parents or stateless;

· by adoption: minor age foreigners adopted by Italians gain citizenship;

· by marriage:the foreign spouse of an Italian citizen, who has resided legally for at least 6 months in the Italian territory or after three years from date of marriage, becomes an Italian citizen.

Moreover a foreigner -whose mother or father or one of the direct line ancestors of second degree are Italian citizens- acquires Italian citizenship:

· if he serves military service for the State and declares his intention of acquiring Italian citizenship;

· if he/she is engaged in public employment at State’s dependency and declares his/her  intention of acquiring Italian citizenship;

· if -at the coming of age, he/she has legally resided in Italy for at least two years and declares his/her intention of acquiring Italian citizenship.

A foreigner born in Italy, who has legally resided in Italy for at least two years, without interruptions, till coming of age, becomes an Italian citizen if he/she declares the intention within one year of coming of age.

Citizenship by concession (or naturalisation) can be requested by foreigner if:

· he/she has resided in Italy for ten years;

· has always been in order with residence norms;

· has a real and regular residence.

 

N.B. Italian laws allow a double or multi citizenship, without renouncing original citizenship.

 

Necessary documents

To obtain Italian citizenship, it is necessary to present a request to the Prefettura of province of residence. Required documentation is very broad and, in general, comprises:

· complete birth certificate;

· family status certificate;

· penal certificate of Country of origin;

· Certificate of Italian Judicial Register and that of pendent offices;

· authenticated copy of passport and residence permit;

· income tax return relative to residence years in Italy.

 

Procedure

· On reception of foreigner’s request, the Prefettura sends it to the Ministry of Interior;

· Police Headquarters opens an inquiry on the regularity of judicial condition of foreigner;

· after taking advice from State Council, Ministry of Interior decides on the concession of citizenship;

· the Italian President enacts the concession decree;

· Civil State Officer receives the oath of loyalty to the Italian Republic.

 

WHO CANNOT OBTAIN ITALIAN CITIZENSHIP

Italian citizenship is not conceded if:

· person has been condemned for offences as of articles I, II and III of Penal Code;

· for reasons concerning security of the Republic.


RESIDENCE

 

WHAT IT IS

When living regularly in a Comune with a regular residence permit, it is necessary to communicate the address to the Register Office of the Comune of residence.

 

ITS USE

Residence allows foreign citizens to register with the National Health Service, to have access to ASL services, to enrol in the Employment Agency (Ufficio di Collocamento) and to open a bank account.

 

HOW TO OBTAIN IT

· The foreigner must go to Register Office of the Comune in which he/she resides and communicate address. After police investigation Comune issues a residence certificate.

· All changes in address must be communicated to the Register Office and names of all those who live at the same address must be registered.

· If living in precarious conditions and in need of stable address, it is possible to use reception centres. The new law on immigration considers also a reception centre in which foreigner has accommodation for more than three months as a stable residence.

· Residence must not be confused with domicile, that is not the place in which one regularly lives and that represents a temporary residence area or site of business.

· All foreigners in the Italian territory must, within 15 days, give notice to the Police Headquarters of any variation of habitual residence.


IDENTIFICATION DOCUMENTS

 

IDENTITY CARD

Requested at the Register Office of Comune of residence.

For issue of identity card it is necessary to be in possession of anagraphic or residence registration. An identity card is one of those documents that can be exhibited by foreigners in case of police control, it is valid only within the Italian territory and has the same validity  as a residence permit.

 

 

REGISTRY CERTIFICATES

Under request of concerned persons, the Comune can issue:

· Birth certificate;

· Residence certificate*;

· Family status*;

· Marriage certificate (if marriage contracted in Italy)*;

· Death certificate.

 

Certificates marked with an asterisk can be presented by concerned person with auto-certification, that is a self declaration, under own responsibility, of his/her registry data and signing this declaration. All false declarations are punished according to law.

 

 

 

 

 


OTHER DOCUMENTS

 

TAX CODE

The Tax Code is a sequence of numbers and letters that are used to identify a person in employment documents or for paying taxes. It is indispensable for employment, to enrol in employment offices or to buy a car. To obtain it a foreigner must present a request at the Register Office of the territory in which he/she lives.

 

ACKNOWLEDGEMENT OF DRIVING LICENSE

Conversion of foreign driving license into the corresponding Italian driving license must be accomplished within one year from date of residence acquisition in Italy.

 

Necessary Documents

In order to obtain acknowledgement of driving licence the following documents must be presented to the Provincial Office of the Motorizzazione Civile:

 

· Conversion request of driving license, which must be filled out on form MC/2112/MECC, freely distributed by the Motorizzazione Civile;

· Residence auto-certification or photocopy of identity card. If documents are not presented by person directly concerned, but by person purposely delegated, residence must necessarily be proved with stamped residence certificate;

· Stamped medical certificate, with signed photo of candidate and signed by doctor, with a date no later than 6 months, issued by USL of residence or from one of following doctors:

- Medical Inspector of Ente Ferrovie dello Stato (State Train Board)

- military doctor in effective Service

- Police force doctor

- doctor responsible for base health services of health district

- Medical Inspector of Ministry of Employment

· Two photos, same as photos on medical certificate;

· Two payments that must be made on forms distributed freely at post offices:

-on c/c n. 9001 for £.10.000 (BLUE BAR)

-on c/c n. 4028 for £.40.000 (GREEN BAR)

· foreign driving license;

· sworn translation of driving license.

 

Foreigner must also present residence permit or receipt of residence declaration or residence card. Such documents must be presented (in original or authentic copy) upon the presentation of request and upon the collection of the converted license.

 

All these matters may be performed, not only directly by the person concerned, but also by an entrusted person, on condition that this person is supplied with a delegation on plain paper. The delegated person must show a valid document of personal identity, besides a photocopy of the directly concerned person’s identity card.

 

N.B.   Whoever possesses a vehicle must:

 

· Stipulate a compulsory insurance policy with an insurance agency present in the territory. This policy must be periodically renewed with payment of sum. The insurance mark must be displayed on the   vehicle windscreen.

· Pay every year to the Automobile Club d’Italia (ACI) a circulation tax (Bollo).

 

HOUSING

 

RENT CONTRACT

The rent contract is the act with which the owner of a house concedes in use his/her place against payment of a monthly sum. A rent contract must be registered at competent Registry Office for two reasons:

 

1. The owner of an apartment must pay tax on sum of money he/she receives from rent;

2. If there are any disagreements with the owner, a tenant cannot be expelled from the apartment arbitrarily.

 

For more inquiries and assistance during the phase of stipulation of contract, it is possible to make inquiries at the Sindacato degli Inquilini (Tenant Association).

 

COUNCIL HOUSES

For assignment of a Casa popolare (Council House – House that is property of the Comune with a very low rent), it is necessary to present request to the Istituto Autonomo delle Case Popolari (IACP) at the time in which announcement of assignment is made. This announcement can be found at the territory competent IACP Office or at the Comune.

 

Requisites to obtain a Council House are:

 

· Italian citizenship, or foreign citizen must present reciprocity certificate issued by Consulate or Embassy of Country of origin. Political refugees must supply recognition certificate of asylum right; refugees must supply the prefetto’s decree;

· Registered residence or employment activity in a comune within the territory to which announcement refers;

· must not be owner or usufructuary of other accommodations;

· Total yearly income of family nucleus not exceeding limit of law.

 

RECEPTION CENTRES AND SOCIAL ACCOMMODATIONS

Reception centres are structures that supply temporary accommodation, mostly free, to those foreigners who have no house or money to pay rent.

For foreigners there also exist social accommodations, collective or private, predisposed by Comuni, Provinces, Regions or voluntary associations. They are prevalently centres organised in the form of hostels, open to Italians and foreigners, with the aim to offer a dignified accommodation at not too high prices.

 

 

 

 

 

 

 

 

 

 

 

 


 

  III       EMPLOYMENT

 

ACCESS TO EMPLOYMENT

 

SUPPOSITIONS

The Italian Republic guarantees equality of treatment and full equality of rights as for Italian workers to all foreign workers and their families, on condition that they reside regularly on the State territory.

 

To gain access to employment, foreigner must possess those documents that allow entry to Italy:

· passport (or equivalent document);

· entry visa, issued by diplomatic representatives or Italian consulates in foreigner’s Country of origin or provenience;

· residence permit, to be requested within 8 days at the Police Headquarters of province in which one resides.

 

Residence permit issued for employment can also be used for self-employment.

Residence permit, if issued for study or training courses, may be converted, prior to expiry, into residence permit for employment reasons, within maximum quotas established yearly by the Italian government.

Residence permit for family reasons allows registration with placement lists for employment or self-employment.

Residence permit for seasonal employment may be converted into residence permit for employment.

Residence permit obtained in order to be liberated from violent situations or serious exploitation (art. 16 L.40/98) allows registration with placement lists and the carrying out of employment activity.

If on expiry of residence permit foreigner is employed, permit must be prorogated or renewed, or can be converted into residence permit for study reasons.

Residence permit for humanitarian reasons can be converted into residence permit for employment reasons and allows registration in placement lists.

 

LISTE DI COLLOCAMENTO (PLACEMENT LISTS)

Fundamental requisite in order to appear on the employment market is the registration with the Liste di Collocamento. It is necessary  to present regular request, on premarked form, at the Sezioni Circoscrizionali for employment, enclosing:

· residence permit, or receipt of request presented to Police Headquarters;

· identity document;

· employment card issued (also temporarily) by the Servizio Ispezione del Lavoro (Employment Inspection Service);

· family status (see Chap. II), if there are family dependants (in order to gain points in list);

· residence certificate;

· study titles and training certificates: foreign workers may request recognition of professional training certificates obtained abroad and may participate in all professional training courses programmed in Italy (see Chap. VI).

 

Foreign student may obtain a special employment card in order to enrol in the placement lists for student workers at the Provincial Direction of employment.

For foreigner not yet resident in Italy, request of employment card must be made by employer upon employment authorisation from the Provincial Direction of Employment.

Foreign worker who is dismissed may be enrolled again in placement lists for residual period of validity of residence permit and anyhow for a period not exceeding one year, unless residence permit was not issued for seasonal work.

 

HIRING

Foreigners already living in Italy

Foreigners regularly enrolled in placement lists may be employed (like Italian citizens) with a direct passage, with nominal request, with apprenticeship contracts and with training and employment contracts. Employer that employs a foreigner must communicate to the Police, within  hours from employment, worker’s particulars and duties for which he/she is employed. Then, within 5 days, communication of employment must be made to the Sezione Circoscrizionale per l’Impiego (SCICA).

 

 

 

Foreigners who do not live in Italy

· Foreigner, with the employment promise/offer of employer who has the intention of employing him/her, and with employment authorisation which employer required at the Direzione Provinciale del Lavoro, must go to the Italian Consulate of his Country and request entry visa.

· Before sending employment authorisation to foreigner, employer must present authorisation to competent Police Headquarters that gives the nihil obstat.

· Once obtained authorisation, dependant employment relation must be established within and not over 180 days (this is in fact the length of employment authorisation).

· Within 8 days from entry, foreigner must request a residence permit for working reasons, with a 2 year validity.

· At this point employer may request employment card from the Servizio Ispezione del Lavoro, which allows enrolment in placement lists and perfection of engagement.

 

If the Direzione Provinciale does not pronounce within 90 days, employment authorisation is meant issued; the latter must be used within 6 months from issue.

In order to obtain employment authorisation employer must prove he/she can destinate an accommodation for worker and must enclose a copy of contract he/she has intention to stipulate with worker.

 

Guarantee service

An Italian citizen or a foreigner who regularly resides in Italy, regions, local boards, professional and trade unions associations, boards and voluntary associations that have been operating within the field for at least 3 years, may guarantee a foreign citizen, with a nominative request to Police Headquarters of province of residence, in order to allow entry and enrolment with placement lists (see Chap. I).

 

Penalties

Italian laws provide arrest from 3 months to 1 year and a fine ranging from 2 million to 6 million for employer who employs foreign workers, also seasonal, without residence permit or with expired, revocated or void residence permit.

 

 

 

 

 

 

 

DISSOLUTION OF EMPLOYMENT

 

Foreign workers have the same treatment of Italian workers for what concerns dissolution of employment.

 

HOW DISMISSAL OCCURS

· Dismissal (of any type) must be communicated in written form. Worker, within 60 days from communication, if he/she wants to appeal against dismissal, must contest it with any written act.

 

· In case of dismissal for disciplinary reasons, sanction must be preceded by written objection of deficiency, following which worker has 5 days time to supply his/her own justifications.

 

· Particular cases excepted (directors, domestics, professional sportsmen...), dismissal of employer must be supported by justified reason or cause, that is of a so serious deficiency that it cannot allow prosecution, even temporarily, of work relation. In case dismissal occurred for justified reason, it is worker’s right to have a period in which contract is still applied and during which worker may search another occupation. In case obligation notice is not respected, employer must pay a substitute indemnity.

 

· When a company with more than 15 workers (for staff reduction or company transformation) dismisses more than 5 workers in 120 days, it is the case of collective dismissal. In these cases special procedures are provided, in which trade unions are to be involved.

 

· Whatever the cause of dissolution of work relation, worker always has the right to a Trattamento Fine Rapporto (TFR: end of relation treatment), that consists in a yearly reserve fund of a quota of retribution, periodically revalued, the payment of which is differed to the moment of dissolution of work relation. In some particular cases (health expenses or purchase of first house) a part of this sum may be forwarded to worker employed in major companies.

 

· In case of dismissal, it is advisable to enquire at trade unions or with a solicitor specialised in these matters.

 

DUTIES OF EMPLOYER

Employer must communicate end of working relation instituted previously with foreigner, within 5 days to the Direzione Provinciale del Lavoro that had issued working authorisation. Same communication must be made to Police Headquarters that had issued residence permit.

        

DISMISSAL IS NOT ALLOWED

· The law considers void (that is as if it never occurred) a dismissal on the grounds of political belief or religious faith, belonging to a trade union or participation to trade union activities. This, obviously, whatever is the “formal” motivation of employer.

 

· Dismissal of worker because pregnant or in Puerpery”, that is the beginning of gestation till one year from birth of child is void. In the case employer had no knowledge of state of pregnancy, dismissal can be contested within 90 days, upon presenting gestation certificate. Dismissal for cause, end of company activity, expiry of term contract, for negative result of trial are exceptions.

 

· Dismissal of workers within period between marriage publication and year successive to marriage is void, except hypothesis afore mentioned. Also in these cases dismissal can be contested within and not over 60 days from written or oral communication from employer.

 

 

 

 

 

 

 

 

 


 

SPECIAL REGIMES

 

SEASONAL WORKERS

Employer who has the intention of employing a foreign seasonal worker must present request, nominative or not, to the peripheral office of Ministry of Labour and Social Previdence. The latter, respecting the maximum quotas fixed yearly by the Italian Government and upon verifying that conditions offered to foreigner are not inferior to those provided by national collective contracts, issues a seasonal employment authorisation.

This is valid from a minimum of 20 days to a maximum of 6 months (or 9 months in some working sectors).

At the end of working period, worker who re-enters regularly into his/her own Country has right of precedence for the following season.

The new law on immigration provides the formation of special placement lists in which foreign workers who intend to do seasonal dependant activities, and who come from Countries with which Italy has stipulated conventions or special agreements shall be inserted.

Seasonal worker are covered by IUS insurances, sickness, gestation and accidents. Instead of contributes for family cheques and unemployment, employer must pay INPS a sum of same amount, appointed to socio-assistancy interventions.

 

SHOW WORKERS

Engagement is subject to issue of special authorisation from Special Placement Office of Show Workers (with site in Roma and 3 decentrated offices in Milan, Naples and Palermo), with opinion of Minister for Tourism and Show and the issue of a temporary nulla osta of the provincial authority of Police.

From a contributive point of view, the position of show workers is the same as that of workers in other sectors (registration with ENPALS for pension fund contributions; registration with INPS for Gescal contributes).

 

PROFESSIONAL NURSES

Graduated nurses from all foreign countries may work in Italian hospitals and private clinics, upon validation of foreign diplom. .

 

SELF EMPLOYED AND FREE PRACTITIONER

Foreign citizens may carry out, in the Italian territory, non occasional activity of self employment (industrial, professional, artisan or commercial) unless it be an activity reserved by law to Italian citizens or citizens of the European Union.

 

In order to carry out the following activities, a foreigner must:

· dispose of adequate resources in order to exercise desired activity;

· has the requisites provided by the Italian law for the exercise of that activity;

· has a certificate from which results that there are no motives that may block the issue of required license;

· has an adequate accommodation;

· has a yearly income, of allowed provenience, which is sufficient for the participation in health expenses.

 

If all these requisites are present, foreigner may obtain entry visa in order to carry out self employment (with the precise indication of activity). This visa must be issued within 120 days from presentation of request with relative documentation.

 

Artisans or business men/women                             

In order to carry out these activities it is necessary to enrol in the Commercial Register (Registro degli esercenti il commercio) which is obtained at the Chamber of Commerce upon taking an exam that attests the knowledge of Italian and a school degree comparable to the elementary licence.

Itinerant workers 

Licenses for itinerants are issued by the Comune in which activity is to be carried out, but always compatibly with program orientations of the giunta comunale on itinerant commerce.

 

Free professionists

Solicitors, doctors, architects etc., in order to carry out their activity must enrol in the relative professional list.

Foreigner with regular residence permit and with university degree or diploma obtained in Italy or who has obtained recognition of study titles (see Chap. VI) can participate to abilitation exams and obtain registration with professional lists in his/her branch of activity.

 

SOCIAL CO-OPERATIVE

A social co-operative is a firm that reunites different people, who put in common their professional competencies in order to carry out an activity of social nature. Social co-operatives supply services or goods to realise social integration of all citizens. They are also called solidarity co-operatives and have been instituted with the law 381 of 1991.

 

Type A co-operatives

They supply socio-health and schooling services (home nursing assistance; home assistance to elderly, handicapped or minor people; management of nursery schools; management of communities for drug disintoxication or reception of minors with penal precedents; centres that carry out cultural activities, such as language courses and world education, seminars and meetings, exhibitions and theatre; etc.).

 

type B co-operatives

They carry out different activities (agriculture, industrial, commercial, services) in order to insert disadvantaged people: physical, psycho and sensorial invalids, ex inmates of psychiatric hospitals, patients under psychiatric treatment, drug-addicts, alcoholics, minor children in working age with family difficulties, convicts admitted to alternative detention measures.

 

 


 

  IV    SOCIAL SECURITY AND ASSISTANCE-WORKING RIGTHS

 

SOCIAL SECURITY TREATMENT

 

For foreigners the choice of working for a social co-operative or the founding, with others, of a co-operative, may be a way of carrying out an activity and finding a regular employment.

 

Article 38 of the Italian Constitution provides that adequate measures are insured to Italian workers for life exigencies in case of accidents, sickness, invalidity, old age and involuntary unemployment.

Foreigners are treated the same as Italian by law. According to cases there are:

 

Old age pension

On reaching pension age (65 for men, 60 for women); when a certain contributive period has been reached (20 years); when dependant work relation ends; in these cases one has a right to claim an old age pension. Exceptions are: usurious jobs, blind workers...

 

Seniority pension

All workers who reach the minimum required contributive seniority (35 years), along with a certain anagraphical age (that ranges from 52 to 57) have the right to this pension. Also workers who independently from their age have reached a determined contributive seniority (that ranges from 35 to 40 years) have right to this pension.

In any case working activity must end.

 

Pension to survivors

Survivor family members of person already recieving a pension have right to obtain pension (or who at the moment of death had obtained relative right).

 

Inability pension

In order to obtain pension, unable person is that worker who for a physical or mental defect is in the absolute and permanent impossibility of carrying out any working activity. If working ability is reduced to at least 1/3, relative to occupations adapted to one’s capacity, person has right to a disability cheque. The latter, not being a pension, is not reversible to survivors.

 

Contributive old age pension

It is the new system to calculate pensions, that substitutes old age pension and seniority pensions for those who started employment after the 1st of January 1996. It is determined on the base of contributive payments; minimum age for all is 57 (men and women), with at least 35 years contributions paid. Who, reaching these requisites, continues working activity, shall enjoy a higher pension.

 

Un-employment bonus

Worker who has 2 years compulsory insurance and 1 year contribution in the preceding two years, who has a residual working capacity and who presents request to INPS within 60 days from beginning of unemployment, has right to bonus.

 

 

 

 

 

 

 

WORKERS' RIGTHS PROTECTION

 

TRADE UNIONS

Trade unions are associations that protect workers’ rights by exerting a representative power of workers registered. Registration generally requires payment of a social sum.

 

There also exists employer trade union associations.

 

In the major companies unitary trade union representatives are provided, representatives that are elected by workers and who let employers know problems of workers of company.

 

 

PATRONATO INSTITUTES

Patronati are constituted by initiative of the national association of workers, also without trade union nature, and which give free assistance in order to obtain, in administrative sites, any type of service, provided by law, statutes and contracts, and that concern workers.

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 


  

V       HEALTH

 

FOREIGNERS WITH REGULAR RESIDENCE PERMIT

 

REGISTRATION WITH THE NATIONAL HEALTH SERVICE

Foreign citizens who reside regularly in Italy and their dependant family with regular residence permit have the right to assistance supplied by the Servizio Sanitario Nazionale (SSN), with equal treatment and equal rights and duties of Italian citizens for what concerns payment of contributions, assistance supplied by SSN and its validity. In order to obtain this assistance it is necessary to register with the SSN.

 

Who can register with SSN

· foreigner with regular residence permit and in dependant working activity, self-employed or registered with placement lists;

· foreigners with regular residence permit who have requested renewal for dependant work, self-employment, family reasons, political or humanitarian asylum, for asylum request, for adoption, entrust, for acquisition of citizenship.

 

How to register

Registration with SSN may be accomplished directly at the ASL (Local Health Unit) of area in which foreigner resides. To register with SSN a percentage contribute must be paid, equal to that valid for Italian citizens, the amount of which is determined by the Minister of Health together with the Minister of Treasury. Contribution is not valid for family members who depend on foreigners that are in Italy for study reasons or au pair.

Upon registration a tessera sanitaria (health card) is issued, an indispensable document for treatment and services supplied by ASL and conventioned medical presides.

Useful information

· The following foreign citizens must stipulate an insurance policy valid also for family members, against the risk of sickness, accident and maternity with a foreign or Italian insurance company or through registration with SSN:

- foreigners in compliance with residence permit who do not fall into categories afore mentioned;

- foreigner present in Italy with residence permit for school reasons;

- foreigners in compliance with residence permit au pair.

 

· Health assistance is warranted also to foreigners not registered with SSN -foreigners who may be foreigners regularly present in Italy for a temporarily period of time or foreigners who do not have to register with SSN- who must pay, as payment of services, special tariffs determined by regions or autonomous provinces.

 

 

 

 

FOREIGNERS WITHOUT REGULAR RESIDENCE PERMIT

 

The new law provides that foreigners present on the national territory who have not complied with rules concerning entry and residence, are to be insured ambulatorial and hospital cures urgent and essential for sickness and accidents and that preventive medicine programs be extended to foreigners not regularly residing.

 

In particular are warranted:

· protection of pregnancy;

· protection and health of minor;

· vaccinations;

· international prophylaxis interventions;

· prophylaxis, diagnosis and cure of infective disease.

 

To foreigners without regular residence permit, the ASL of territory on which foreigner resides issues a card (card STP), with which foreigner may have access to all health services in his rights. Applicants without sufficient economical resources will bear no onus, except participation quota for expenses as Italian citizens. For what concerns assurance of indigent condition, an autocertification on state of poverty of interested person will warrant (see Chap. II).

 

Access to health assistance will not require any type of signalling to Police Headquarters of immigrants not regularly residing.

 

 

 

 


 

HOW DOES HEALTH ASSISTANCE WORK

 

FAMILY DOCTOR

In order to be entitled to any type of health assistance, upon registration with SSN, it is necessary to choose a doctor, also known as “medico di famiglia” (family doctor).

 

It is necessary to consult list of doctors at the ASL. For children from 0 to 14 years a paediatrician must be chosen with same modalities of family doctor. Choice of family doctor and paediatrician may be modified in any moment.

 

Every family doctor, chosen through ASL, has a surgery and must warrant, freely, medical visits in his/her surgery and at patient’s home.

 

Family doctors issue at request:

 

· sickness certificates for workers;

· re-admission certificates for schools.

 

Family doctors warrant:

 

· specialist visits requests and diagnostic controls;

· non urgent requests of hospitalisation;

· thermal cure requests.

 

All this is done freely by family doctor.

 

MEDICINES

Medicines are sold only at the chemist. Medical prescription (ricetta) is compulsory for some types of medicine. In the prescription, that is handed to chemists, doctor authorises purchase of medicine. Family doctor supplies freely the prescription, but only after a medical visit.

 

HOSPITALS

In Italy exist public and private hospitals. All those in need may be hospitalised in public hospitals. In any case, hospital firstly cures citizen and then recuperates expense reimburse.

To be hospitalised a request written by family doctor is sufficient, but is also possible to ask directly the Medico di Guardia (Emergency Medical Service) at Pronto Soccorso (Casualty Ward).

In public hospitals staff (doctors, nurses and technicians) do not receive any compensation in money. Requests of this type are abusive and may be denounced to the health direction of hospital.

 

SICK PERSONS’ RIGHTS

In all hospitals, patients have some very important rights:

· information: doctors have the duty to give patient, considering their cultural level and their understanding capacity, the most serene and complete information on sickness of patient.

· Experimentation of medicines and new technologies is allowed only if authorised by the Ministry of Health and after assent of patient, who must be informed adequately on aims, methods, benefits and possible risks. Patient must give written consent and has the right to retire from experimentation in any moment.

· Every patient in hospital has a cartella clinica (clinical card), filled in by curing doctor. On the cartella clinica all health information of patient are written. It is an official document: any violation (cancelling or ripped pages) must be denounced. The cartella clinica is a strictly personal document and only person hospitalised may require a copy at ASL, upon leaving hospital.

· Every patient has the right that no person not connected to the health staff of hospital has knowledge of his/her disease. Doctor must control that the personal cards and documents of patient are kept far from any indiscretion.

· Hospitals must warrant religious assistance for their patients. Hospitals have the duty to procure, upon request of patient, also non catholic ministers of religion.

 

 


 

SERVICES IN FROSINONE

 

VACCINATIONS

Vaccinations are necessary in order for children to attend school. At moment of registration at school (see Chpt. V) parents must show the documentation that certifies the fact that child has undergone vaccinations provided by law.

 

Compulsory vaccinations for children (free)

Anti-diphtheria, anti-tetanus, anti-polio, anti-hepatitis B

they are given at the punti sanità (health points) upon inviting families with notification by post.

 

Optional vaccinations for children (free)

Anti-measles, anti-rubella, anti-parotitis, anti-whooping cough

for these diseases exist vaccination campaigns promoted by Ministry of Health or by Regione Lazio; they are done at the punti sanità presenting families with illustrated pamphlets on vaccination. Written consent on adhesion to supply vaccine to child is required from parents.

 

Optional vaccinations such as

Anti-hepatitis B in non risk categories, anti-cholera, anti-leptospirosy, anti-meningitis, anti-rabies, anti-typhoid

are done at the punti sanità on request of interested person, and are paid for according to tariffs stated by current regional price list.

 

At the punti sanità Vaccination Certificates necessary for registration at schools and to accede to infantile communities may be requested.

 

 

FAMILY PLANNING CENTRE

The Consultorio Familiare (Family planning centre) is a public socio-health service that carries out prevention, information and social, health and psychological services, with the help of qualified professionists at different levels: social workers, health assistance, midwife, psychologist, gynaecologist, paediatrician.

This centre is at the disposition of individuals, couples, groups, families for the following reasons:

 

· maternity and paternity and use of contraceptive methods;

· pregnancy;

· preparation courses to a serene childbirth, home assistance after childbirth;

· sterility;

· prevention of female genital tumour and sexually transmitted diseases;

· consulence and assistance to couples who want to marry, with meeting in order to prevent couples relationship problems, sexuality, hereditariness of syndromes and diseases and illustration in a clear and complete way of the utility of vaccinations and options in prevision of pregnancy;

· sexuality in all the life cycle of an individual;

· menopause and its social health and psychological effects;

· health and control of new-born and child, their psychological and · social development, hygiene and infancy alimentation;

· teenager period (14-24 years), in order to show all sexual effects, so as to live more serenely with others and face eventual personal and family problems;

· problems of couple, relation ship with children and their psycho-physical development;

· abortions (law 194/1978) within third month of pregnancy. It is necessary to undergo a pregnancy test after menstruation delay of at least 10 days and then request certificate of abortion at the Consultorio Familiare. After third month of pregnancy and within sixth month of pregnancy, abortion is allowed only if its prosecution or birth involves serious danger for mother’s life or in the case of verified anomalies or malformations of unborn child.

 

TREATMENT OF AIDS

The Health Unit of Frosinone has a Centro di Riferimento per la prevenzione e la cura dell’Aids (Reference centre for the prevention and treatment of Aids). Following services are available:

 

Test

The test for verification of HIV infection is available from Monday to Saturday, from 8.30 to 13.30. No medical prescription is required and test is free. Before test and at delivery of results a consultation is offered to people interested.

Medical assistance

At the centre advice and assistance can be found for an eventual hospitalisation for insertion in Day Hospital.

 

Psychological assistance

The centre offers also psychological assistance and support therapy to external relatives and to patients, affected with HIV. Family members of aids patients may require psychological assistance.

 

Social assistance

The centre offers to aids patients a consultation for the carrying out of bureaucratic procedures (request of cartella clinica, ticket exemptions, previdential and assistance boards matters...). The centre is also in contact with other territorial services: voluntary associations, residential and reception structures, structures devoted to the home treatment of patients.

 

Home assistance

For patients residing in the territory it is possible to be treated at home, in accordance with modes dictated by the Regione Lazio.

 

Information ad training

The centre organises training courses for health operators, distributes pamphlets and informative material, offers primary prevention to health users and operators.

 

 

TREATMENT OF TUBERCOLOSIS

TBC is a contagious disease that involves mainly the lungs. Disease is caused by a bacteria which is expelled by sick patient under form of tiny drops of saliva by coughing. These droplets are inhaled by healthy people, some of which fall ill.

Symptoms of TBC are: fever, internal cough, sleepiness, loss of weight, catarrh with traces of blood.

If these symptoms are present, it is necessary to refer to the Unità Operativa AIDS e Malattie Infettive della ASL di Frosinone (AIDS and Contagious Diseases Operating Unit of the ASL of Frosinone).

 

 

SERVICES FOR DRUG-ADDICTION

The Dipartimento 3D (Department 3D) of Local Health Unit, with operating unit SERT (Drug-addiction Service), realises, promotes and co-ordinates promotion activities for health, recovery and prevention of addiction derived from drug, alcohol and pharmacological abuse.

 

SERT offers the following services:

· physical and psychological health status control and eventual certification of drug-addiction state;

· psycho-socio-rehabilitation program (individual, family or group psychological assistance, social assistance, methadone administration, disintoxication therapies);

· insertion into recovery communities;

· assistance to drug-addicted prisoners;

· prevention, information and training on drug-addiction problems.

 

MULTI-ETHNIC CONSULTORY

 

An orientation office on health services for foreigners has been opened at the ASL of Frosinone, in Via A. Fabi.

SCHOOL LAWS

The Italian Constitution

According to the Italian Constitution (art. 34) “Schools are open to everybody”. Schools in fact must not make any distinction between sex, language, religion or social condition.

 

Law n. 40 of 6/3/1998

According to article 36 of Law 40/1998:

· foreigners of minor age present on territory are subject to compulsory schooling;

· school community promotes and favours those initiatives towards reception, protection of culture and language of origin and to the realisation of common inter-cultural activities;

· school institutions promote literacy courses for adults in elementary schools and high schools, also in order that foreigner may obtain study title of compulsory school.

 

SCHOOL STRUCTURE

In Italy exist compulsory schools (schools that Italian citizens must attend) and superior schools. Compulsory school is free, and comprises elementary school (five years) and scuola media (high school -three years). Ages for compulsory school are from 6 to 15 years old. Superior school is optional and is not free. It may last from three to five years according to type of school. There exist in fact professional schools (that provide a faster insertion into the working world) and schools that give a deeper general formation (Licei) and that presuppose continuation at University.

Before elementary school, most children attend the scuola materna (kindergarten -optional and free) from ages three to five and some also the asilo nido (nursery schools) -from ages 3 months to three.

At the end of each school grade a study title is obtained. It is important to know that to have these titles is indispensable in many cases for employment.

State schools depend on the Ministry of Public Education. Provincial organ competent on schooling matters is the Provvedidorato agli Studi.

 

Nursery schools

It is a service of the Comune that receives children from ages three months to three years. Nursery schools are open every day except Sundays and holidays and in a summer period (generally August). Time tables and closing periods may vary locally.

Every nursery school receives a limited number of children that during permanence at school are followed by qualified staff in all their necessities (food, sleep, hygiene, play, ect.).

Children whose parents work or reside in the territory of the Comune may be registered with nursery schools. Registration requests must be presented to the Ufficio Asilo Nido (Nursery school office) of the Comune, with all documentation required. Registrations are open all year.

Requests for nursery schools are generally superior to places available: in these cases quarterly lists are made, relying on social and family conditions of parents.

 

A monthly charge is paid for nursery schools, proportioned to income, locally fixed, charge from which parents may be partially exempted by request to the Servizio Sociale Comunale (Comunal Social Service).

Kindergarten

 

Kindergarten receives children from age 3 to 5 and is opened from September to June with different time tables:

short hours (8.00-13.00)

long hours (8.00-16.00).

At moment of registration parent chooses time table.

Child who turns three within the 31 December of year of registration may enrol into kindergarten. Also child who turns three within 31 January may be registered and inserted in a waiting list.

Presentation of registration request is compulsory every year.

 

Upon registration following documents must be presented:

· registration request

· declaration that certifies date of birth and residence of child

· vaccination certificate

· identity document of parent.

 

School refectory service is paid by parents, that may be partially exempt from payment presenting income declaration or un-employment certificate. Request of school refectory service must be presented to the Comune of residence.

 

Elementary school

Children who turn 6 within the 31 December of year of registration attend elementary school. For registration same rules for kindergarten are applied, but passage from one year to another in elementary school occurs automatically, without obligation to register every year.

Elementary school is opened from the second half of September to the first half of June and is organised according to different time tables that correspond to different organised teaching:

 

· module: morning hours + one, two or three afternoon classes with three teachers;

· normal time table: only morning hours;

· full time: from 8.30 to 16.30 with two teachers.

 

Time table is chosen by parents upon registration.

School refectory service, as in kindergarten, is paid by parents, that may be partially exempted from payment. Text books are free.

Support is provided for children in difficulty (for example, activities for a better knowledge of Italian).

 

Scuola media (middle school)

Children who have obtained licenza elementare (elementary licence) or who have a corresponding title are registered in the scuola media.

Attendance to high school is compulsory until obtaining of diploma di licenza media or at least to 14 years of age.

Diploma di licenza media is required in all concorsi.

In high schools time table may be:

· normal: only morning hours;

· prolonged: morning hours + a few weekly afternoon hours.

 

Upon registration parents chose time table and foreign language their children will study. Language is chosen among those provided by school; if request for a foreign language is more than places available, a draw is made.

School refectory service is paid by parents that may be partially exempted from payment.

School texts are paid for by parents. Also for school texts contributions from the Comune are provided.

As for elementary school, Support is provided for children in difficulty for a better knowledge of Italian.


 

Scuola superiore (Superior high school)

Different types of superior high school exist, according to different school addresses: Liceo Classico, Liceo Scientifico, Liceo Artistico, Liceo Linguistico and technical and professional institutes that are more oriented towards a direct insertion into the working world.

Superior high schools last 5 years (from 14 to 18 years of age). At the end of fifth year, students undertake a final written and oral examination (esame di  stato): on passing this exam, students obtain a diploma di scuola media superiore.

School is opened from mid September to mid June (dates vary from regions). Also in some superior high schools exist prolonged hours.

In every city exist different types of schools. In order to know if in one’s city exists the type of school in which one is interested, apply to the Provvedidorato agli Studi, competent organ in all school matters,  which has its site in every capoluogo di Provincia. It is possible to ask for information at the secretary office of schools. It is there, in fact, that all information about registration is available. It is also possible to apply to the Comune or Circoscrizione, and at the school syndicates.

 

Teaching of catholic religion

Among the different subjects taught in the Italian school, there is also catholic religion.

Upon registration in state schools, children and their families must chose if to accept or not teaching of catholic religion, by filling in a form, supplied by school.

Children who do not attend catholic religion lessons may attend courses of alternative subjects organised by the school.

 

PROFESSIONAL TRAINING COURSES

Italian regions (and other public boards) organise professional training courses that may be attended also by foreigners. Most of these courses require possession of diploma di scuola media inferiore.

Registration requests must be presented from 1 to 31 of July at the boards that organise these courses.

For registration with courses registration with placement office is required. Length and time tables of courses vary.

Courses are free and supply students with didactic material, insurance and transport expense reimbursement.

At end of course, if student passes exam, student receives a qualification certificate.

 

Courses are divided into sectors, following are a few of them:

 

· artisan sector;

· industry;

· commercial;

· information;

· tourism-reception.

COURSES FOR WORKERS

Courses for adults in order to obtain of licenza media are organised every year by the Ministry of Publicc Education.

 

Who can register

All those who are or have turned 16 within 31 December on year related to registration, can participate. Those who posses a licenza media may attend courses as auditors.

 

How to register

Terms for registration to courses expire on 15 July. Request according to model, must be addressed to the Preside of a state scuola media that promotes courses for workers. To request must be enclosed a birth certificate and for those who have not turned 23, certificate relative to study title already possessed.

 

VALIDATION OF FOREIGN DIPLOMA

 

If person desires to utilise study title obtained in country of origin, person must present request to the Ministero della Pubblica Istruzione D.G. Scambi Culturali – Div. III, via Ippolito Nievo, 35 – 00135 Roma, enclosing following documentation:

 

· study title in authenticated copy, with Italian certified translation conform to foreign text sworn by an official translator or by diplomatic or consular Authority of foreign Country where title was issued, and that operates in Italy;

· value declaration, issued by one of afore mentioned diplomatic or consular authorities, regarding:

- juridical position of school (state or legally recognised);

- order and grade of studies to which title refers, in accordance with current school order of country in which title was obtained;

- total school years;

- effects as to prosecution of studies or work engagement.

 

 

UNIVERSITY

Who can register

· Students legally residing in Italy with residence permit conceded in one solution for at least one year (for employment, self-employment, study or family reunification, placement list registration, elective residence reasons and other long term residual permits) shall be admitted to Italian Universities upon promotion of specific pre-registration exams and within limits of places at disposition in every university for every Academic Year.

· Foreign titles that allow access to Universities of country of educational system they refer to and that have been obtained at the end of a school period equal to at least twelve years, are valid titles for access to Degree Courses or to University Degree at Italian Universities.

 

How to register

Person interested must send in April-May, with suitable postal means (registered with return receipt, registered or other means with similar warranties), or may present by thirds, pre-registration application to the Italian representative in country of last residence.

Application forms shall be at disposition at the Segreterie Studenti Stranieri (Foreign Students Secretary) of Italian Universities.

 

Pre-selective tests

Foreign candidates must compulsorily undertake an Italian knowledge test.

Further exams, that after the Italian exam must be undertaken with Italian candidates are compulsory for some Degree Courses or University Diplomas (especially for closed number courses).

Those who do not pass Italian test will not be admitted to further attitudinal tests -when provided.

 

Political refugees

Political refugees will not burden contingent of places available for foreigners allowed to individual Universities. They shall have to undertake the same admission exams of foreign students, being anyhow foreign citizens.

In April-May, political refugees must apply to the Servizio Sociale Internazionle -Via Veneto, 96 Rome that will supply them with the necessary assistance for application of admission request and of prescribed documentation.

Interested people can obtain all useful information at the Segreterie Studenti Stranieri of Italian Universities.

IT'S GOOD KNOW THAT…

 

The Italian territory is divided in:

These local boards are competent for administration of territory, management of its resources and organization of all services on its territory.

 

Foreigner may apply to the Comune of residence to obtain information and certificates relative to civil status and residence (see Chap. II).

 

Police Headquarters is in every capoluogo of province: it depends from the Ministry of Interior where a foreign office is present,and  that is competent for issue and renewal of residence permit and residence card.

 

 

 

 

 

 

 


 

FOREIGNERS AND JUSTICE

 

 

WHAT TO DO IN CASE OF ARREST, DETENTION, SEARCH

 

In case of police control, it necessary to exhibit passport and residence permit or card. Non exhibition of document is an offence punished with arrest till 6 months and a fine to £.800.000. Personal generalities must compulsorily be supplied (name, surname, address). To supply false generalities or refuse to give them is an offence.

 

 

DEFENDER

 

· In case of detention or personal or house serch or in case of sequestration, person has the right of having the assistance of a defender. If no solicitor is known, it is possible to ask for a defender appointed by Court, who is chosen among a list at disposition at all police forces and court offices. If it is not possible to pay defender it is possible to apply for a free support institution (see further).

· In case of questioning in front of Police or Carabinieri, person has the right of not answering and to contact a solicitor or to ask Carabinieri to contact a solicitor and to speak only in presence of solicitor.

 

 

FREE SUPPORT

 

Free support is an institution that insures non wealthy people juridical protection of his/her own rights, warranting the assistance of a defender paid by the State. In order to obtain free support, applicant must supply:

 

· notorial act or substitute declaration that certifies that subject has no real estate or transcribed furniture;

· declaration of Comune of residence that foreigner has presented to tax revenue;

· certification of embassy of country of origin that certifies above mentioned requisites;

· family status;

· application form with indication that foreigner commits him/her self to communicate any income variation to the Intendenza di Finanza.

ACTION AGAINST DISCRIMINATION

 

According to the Italian law, discrimination is defined as any behaviour that involves an exclusion, restriction or preference based on race, colour, origin, religion, that compromises recognition or exercise of human rights and of fundamental liberties. A discriminatory behaviour punished by law is that of who does not allow foreigner the fulfilment of employment, residence, education, training, socio-assistance services rights only because of his/her status of foreigner.

When behaviour of private or public administration determines discrimination for racial, ethnic, national or religious reasons, the judge may, upon request of person interested, order the cessation of discriminatory behaviour, adopting any other suitable measure to remove effects of discrimination and eventually condemn discriminant to compensation of damage, patrimonial and moral. Competent judge is the judge of place of residence; appeal against his/her measures may be exercised at Court.

 

OFFENCE OF DISCRIMINATION

Following the serious episodes of racist violence, in 1992 a law has been issued that provides a more severe punishment when offence of violence to things or person are committed with the aggravating circumstance of discrimination (see preceding paragraph).

It is also forbidden the constitution of associations with the sole aim of organised violence against people belonging to ethnic, religious, linguistic minorities etc.

 

 

 

 


CULTURAL MEDIATOR

 

 

The cultural mediator is a foreigner to whom is given the task of facilitating daily life, the understanding of the country’s organisation, the access to public services, the possibility to express and communicate in Italy for foreigners, and to supply all information that may be useful for foreigner. At the same time cultural mediator must promote occasions of cultural exchange and mutual knowledge for Italians. This figure was instituted with a regional law. To become a cultural mediator, it is necessary to attend a course organised by the Region.

 

 

 

 

 

 

 

 

 

 

 

 

 


 

PARTECIPATION INSTRUMENTS

 

 

WHAT IS A CONSIGLIO COMUNALE

 

The Comune is an autonomous territory board, whose autonomy is realised through co-ordination and control of police, housing, hygiene, office organisation and it also has the power to give itself a political address through the Giunta Comunale (Comune Junta) and the Consiglio Comunale (Municipal Council).

The Consiglio Comunale is a collegial organ elected by citizens. Number of members vary from 15 to 80, in proportion with number of inhabitants. The Consiglio Comunale has deliberative functions and elects a more restricted organ within its members that have executive functions (Giunta Comunale).

 

 

ADDED CONSIGLIERE COMUNALE

 

It is the counsellor elected by foreigners who reside in the Comune through specific elections.

He/She participates to the works of the Consiglio Comunale in order to realise initiatives or to discuss problems relative to immigration, but has no right to vote. To institute the added consigliere comunale it is necessary to apply for a modification of status of Comune, in which aim of foreign integration into civil and political life must be specified and election forms of member must be established and modality of election execution.

 

To vote it is necessary:

 

· to be 18 years old;

· reside in the Comune in which person wants to vote.

 

One or more consiglieri may be elected and their institution must be deliberated by the Consiglio Comunale with actuation rules. During the consigli comunali the added consigliere has no right to vote, but only the faculty to participate to discussions as representative of foreigners residing in the Comune. The added consigliere has also right of speech in the preliminaries of discussion of subjects to be discussed, in ways approved by the other consiglieri.

 

FOREIGNERS INVITED TO THE CONSIGLI COMUNALI

 

They are particular guests of consigli comunali in which questions linked to immigration are discussed; it may be a foreigner chosen within the field of immigrant associations, among experts on determinate sectors or committed in voluntary works.

 

FOREIGNERS COUNCIL

 

It’s a consultative organ of foreigners by territorial different communities chosen by immigrants living in the town.

To institute the foreigners council it is necessary to apply for a modification of status of Comune.

A foreigners council has its own specific rules.

 

NATIONAL FUND FOR IMMIGRATION POLITICS

 

The Social Solidarity Ministery issued a fund to finance activities for recognition and the application of immigrants basic rights. The fund also promotes foreigners integration, prevents and removes every discrimination and tries to reinsert foreigners in the original country.
